
A Ventura resident who has been accused of a gang-related shooting in Santa Paula last year will have to go to court, a judge recently announced.
According to several witnesses, 42-year-old Lucas Macias drove to a Santa Paula home and went to the back patio, where about 20 people were attending a party on September 12, 2010. Witnesses describe Macias as firing two or three times at two victims: 19-year-old Luis Hernandez and Damian Magana.
Magana was shot in the leg; Hernandez, who was shot in the stomach, later died of his wounds.
Macias was arrested two weeks after the crime and was charged with two counts of assault with a firearm and street terrorism. Police believe the crime was committed on behalf of Macias’s Santa Paula street gang.
Ventura County Superior Court Judge Kevin DeNoce ordered that Macias' bail be set at $2.8 million.
Macias' lawyer tried to get charges dismissed, saying there was no evidence against his client because the witness’ descriptions of the shooter were inconsistent, and that police testimony showed Macias hadn’t participated in gang activity for six years.
Macias pled not guilty to two counts of attempted murder and will stand trial in 2012.
