Voting In California After A Felony Conviction

Some prisoners and felons are under the incorrect perception that once convicted of a felony, you may never vote again. This is not true in this state – and in many others states across the country. California law states that felons lose their right to vote only when they are incarcerated or on parole. Upon their release from prison or their completion on their sentence, they are once again allowed to legally vote and may re-register whenever they like. Those on probation are also allowed to register and vote.

The current law regarding the voting rights of felons was decided by Proposition 10 in 1978. Before that time, felons in California were never able to vote again for the rest of their lives after a conviction.

Of course, to be eligible to vote in elections in California, you must also fulfill a number of other requirements: you must be a United States citizen and a California state citizen, you must be 18 or older, and you must never have been found to be mentally incompetent in court.

It is important to note that your voting rights are not affected if you have been jailed for crimes that are misdemeanors, if you are awaiting trial for a misdemeanor or a felony, or if you have been charged but not convicted of a felony. Those in jail who have not been convicted of a felony can register to vote and vote by mail.
